Welcome to Domani Home Design (store name) and its digital products. ("the Product")! These Terms of Use ("Terms") govern your use of the Product and outline the rights and responsibilities of both you and Domani Home Design ("we" or "us"). By accessing or purchasing the Product, you agree to be bound by these Terms and any additional marketplace terms. If you do not agree with any part of these Terms, please do not ​purchase, or use the Product.

You affirm that you are at least 18 years old and have the legal capacity to enter into these Terms for yourself or for the organization you represent.

​Purchasing and Delivering

All Products are sold as is. No warranties or guarantees are made regarding the suitability of any Product for a particular purpose or the results to be obtained from their use.

​Upon receipt of full payment, the Product will be delivered in a digital format via a download link via email to the email address you provide during the checkout process.

​License and Usage Restrictions

We grant you a non-exclusive, non-transferable, revocable license to use the Product solely for personal use. This license does not grant you ownership of any intellectual property rights in the Product, and you agree not to copy, modify, distribute, sell, or lease any part of the Product unless expressly permitted by us.

👍 - YES! You can use this digital product for a one-time build for yourself.

👎 - NO! You cannot make this digital product available for download for others, email it to a friend, share a link in a Facebook Group, allow someone else to make photocopies for their personal or business use, etc.

User Responsibilities

You agree not to use the Product for any unlawful or unauthorized purposes, and you will comply with all applicable laws and regulations.

Intellectual Property

All intellectual property rights in the Product, including but not limited to copyrights, trademarks, and trade secrets, are owned by us or our licensors. You agree not to infringe or misappropriate any intellectual property rights related to the Product.

Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the use or inability to use the Product. We do not guarantee the accuracy, reliability, or completeness of any information provided by the Product. You acknowledge that any reliance on such information is at your own risk.

No Refund Policy

Due to the digital download of our Products and you are granted immediate access, absolutely no refunds or exchanges are available for Products.

Before making a purchase, we strongly encourage you to take all necessary steps to ensure that the Product you select meets your needs. This includes but is not limited to, checking that a house plan complies with local building codes and regulations, fits your lot, and meets your aesthetic and functional preferences.

Governing Law and Jurisdiction

These Terms will be governed by and construed in accordance with the laws of the State of Utah. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of the State of Utah.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and Domani Home Design regarding your use of the Product and supersede any prior agreements or understandings, whether written or oral.

These Terms are in addition to any terms that you agree to upon purchasing through a third-party marketplace like (but not limited to) Etsy, Amazon, or TPT.
